Welcome to BreakHunter. By accessing or using our website at breakhunter.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

1. About BreakHunter

BreakHunter is a search and discovery platform that aggregates publicly available information about live sports card break events ("breaks") from third-party streaming platforms including Whatnot, YouTube, and others. BreakHunter does not conduct, host, facilitate, or guarantee any card break transactions. We are an informational directory only.

2. Acceptance of Terms

By using the Site, you represent that you are at least 18 years of age, or that you are the parent or legal guardian of a minor using the Site with your consent. You agree to use the Site in accordance with these Terms and all applicable laws and regulations.

3. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable local, state, national, or international law
  • Scrape, crawl, or otherwise extract data from the Site without our express written permission
  • Use automated tools to access the Site in a manner that overloads our infrastructure
  • Attempt to gain unauthorized access to any part of the Site or its related systems

4. Third-Party Platforms and Content

BreakHunter displays information sourced from third-party platforms ("Third-Party Content"). We do not endorse, verify, or take responsibility for any Third-Party Content, including but not limited to:

  • The accuracy of break listings, prices, or descriptions
  • The conduct, reputation, or reliability of any individual breaker
  • The authenticity, condition, or value of any cards broken or sold
  • Any transactions, disputes, or agreements between users and breakers

When you click through to a third-party platform, you are subject to that platform's terms of service and privacy policy. BreakHunter is not a party to any transaction conducted on third-party platforms.

5. Partner Breakers

Breakers who apply to be listed as "Partner Breakers" on BreakHunter agree that:

  • All information submitted in their application is accurate and truthful
  • They will conduct all breaks in compliance with applicable laws and the terms of their respective streaming platforms
  • BreakHunter reserves the right to remove any partner listing at any time for any reason
  • A "Partner" or "Verified" badge does not constitute an endorsement of a breaker's services
  • BreakHunter is not liable for any disputes between partner breakers and their customers

6. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Any information on the Site is accurate, complete, or current
  • The Site will meet your specific requirements
  • Any defects will be corrected

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BREAKHUNTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Site
  • Any conduct or content of any third party on the Site
  • Any content obtained from the Site
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any transactions or interactions with breakers found on the Site

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100).

8. Indemnification

You agree to defend, indemnify, and hold harmless BreakHunter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

9. Intellectual Property

The BreakHunter name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BreakHunter. You may not use such marks without our prior written permission. All other trademarks, service marks, and logos used on the Site are the property of their respective owners.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
